Who needs a health spa bond?
In the State of Kentucky, health studios are required to obtain a surety bond to be in compliance with the KRS section 367.900 of the Kentucky Statutes. Every health studio which sells contracts for health studio services to be rendered at a planned health studio or a health studio under construction shall purchase a security bond in an amount not less than $50,000, or shall file with the division an irrevocable letter of credit by a surety company or lending institution permitted to do business in the state.
What is the health spa bond?
The health spa bond protects the party requesting the surety bond, the Obligee, against any financial losses as a result of poor financial choices, damages, unethical decisions, or a failure to adhere to state and local laws on the part of you, the Principal. By obtaining your bond, you are telling the Obligee that you can be trusted and that you stand by your business decisions.
"Health spa" means an establishment, except those defined as nonprofit organizations under 26 U.S.C. sec. 509(a), which provides for profit as one of its primary purposes, services or facilities which purport to improve the user's physical condition or appearance through participation in sports activities, fitness training, exercise, or body building. The term includes establishments that offer access to any of the following facilities: gymnasiums, swimming pools, tracks, ball courts, weight lifting equipment, exercise equipment or facilities, saunas, steam baths, or whirlpools. It does not include establishments that limit their services primarily to diet counseling and the provision of special dietary foods.
Kentucky health spa bond must be written in an amount determined by the number of current, unexpired contracts that the spa has in effect, as follows per Kentucky statute:
