Individuals who apply for a pump installer license as a well driller must meet certain qualifications and post a surety bond.
The drilling, construction, deepening, repair, renovation, replacement, cleaning, development, abandonment, and pump installation/repair of the following well types, if greater than 30 feet deep, is regulated by the Administrative Rules for Water Wells and the applicable work must be completed by a licensed water well driller or licensed pump installer:
- Private Water Production Wells (e.g., domestic, stockwater, irrigation, industrial, and commercial wells)
- Public Water System Supply Wells
- Recharge and Recovery Wells
- Cathodic Protection Wells
- Heating and Cooling Exchange Wells (Both closed-loop and open loop vertical systems)
- Test Wells and Monitoring Wells, and Piezometers
- Inclinometers and Dewatering Wells if they affect an established aquifer

Who needs the well driller bond?
A person, partnership, association, or corporation may not engage in the business of water well construction, the installation of water well pumps, pitless units, or other appurtenances, or both, or drilling of geothermal systems, unless a ceritfied water well contractor, water well pump and pitless unit installer, or geothermal system driller is in charge. It is the responsibility of any person, partnership, association, or corporation engaged in the business of construction of water wells, the installation of water well pumps, pitless units, or other appurtenances, or both, or drilling of geothermal systems, to comply within the meaning of this chapter pursuant to North Dakota Century Code chapters 23-01, 43-35, and 61-28.1.
One year's experience as required by statute shall consist of 12 months of full time employment in drilling water wells under the direct supervision of a certified water well contractor, which experience shall have occurred during the three years immediately preceding the date of application, or suitable vocational training approved by the board. The board may, upon application and request, approve equivalent experience under a non-licensed water well driller if the experience was in a state other than North Dakota and if the board is satisfied that the experience was the equivalent of working under a certified water well contractor in North Dakota. Monitoring well contractors may qualify if they hold a bachelor's degree in Engineering or Geology. The board may certify other experience as equivalent as it finds appropriate. Certified monitoring well drillers are not certified to construct production wells.
What is the well driller bond?
The $2,000 well driller bond protects the party requesting the surety bond, the Obligee, against any financial losses as a result of poor financial choices, damages, unethical decisions, or a failure to adhere to state and local laws on the part of you, the Principal. What else do I need to obtain or renew my license?
Any person desiring to take the examination to become a certified water well or monitoring well contractor shall first have completed a minimum of one year apprenticeship or experience in water well drilling and construction under the direct supervision of a certified water well contractor or have completed a vocational school program of at least one year in water well construction and shall make application to the Board and pay to the board treasurer a nonrefundable examination fee.
